1. About this Website

This Site is operated as a personal marketing site for Mona Osman, Sales Representative. Mona Osman is not the Brokerage. All real estate trading activities are carried out by, through, and under the supervision of the Brokerage in accordance with TRESA and the Code of Ethics. References to “we,” “us,” or “our” on this Site refer to Mona Osman unless context indicates the Brokerage.

2. No Client Relationship

Your use of this Site, including the submission of a contact or inquiry form, sending an email, or any other communication through or in connection with this Site, does not by itself create a client relationship between you and the Brokerage or Mona Osman. Under TRESA, a client relationship arises only upon the execution of a written representation agreement (a Buyer Representation Agreement, Seller Representation Agreement, or equivalent) between you and the Brokerage.

Until such an agreement is in place, you are treated as a self-represented party (“SRP”) under TRESA. You should not share confidential information through this Site that you would not be comfortable sharing with the public. Mona Osman will deliver the RECO Information Guide and applicable disclosures before providing services that require them.

3. No Real Estate, Legal, Financial, or Tax Advice

The information published on this Site — including listing descriptions, neighbourhood notes, market commentary, articles, and any other content — is provided for general informational and marketing purposes only. Nothing on this Site constitutes real estate advice for your specific transaction, and nothing on this Site constitutes legal, financial, mortgage, tax, accounting, insurance, or appraisal advice.

Real estate transactions are highly fact-specific. Information that is accurate in one transaction may not apply to yours. You should consult qualified professionals — including a lawyer, mortgage broker or lender, accountant, and home inspector — about your specific situation before making any decision.

4. Listing Information — Accuracy and Currency

Listing details on this Site — including price, square footage, room counts, taxes, lot size, year built, MLS® number, photographs, and feature descriptions — are provided in good faith and are believed to be accurate at the time of posting. They are not warranted. Listings, prices, availability, and status (Active, Coming Soon, Conditional, Sold) can change without notice.

You should verify all material facts about any property you are considering with Mona Osman, the listing brokerage, the relevant municipality, and your own professional advisors before relying on them. Floor plans, virtual tours, and renderings are illustrative only.

5. No Guarantee of Outcome

Nothing on this Site constitutes a guarantee, warranty, or prediction of any particular outcome in any real estate transaction — including the sale price of a property, the speed of sale, the success of a purchase offer, or the future value of any property. Past results do not guarantee future results.

6. Multiple Representation

From time to time, the Brokerage may represent both a buyer and a seller in the same transaction (a “multiple representation”). Where this arises, the Brokerage will obtain written consent from both clients in accordance with TRESA before continuing. The disclosures and obligations associated with multiple representation are explained in the RECO Information Guide, which will be provided when applicable.

7. MLS® Trademarks and Realtor® Designation

The trademarks REALTOR®, REALTORS®, and the REALTOR® logo are controlled by The Canadian Real Estate Association (CREA) and identify real estate professionals who are members of CREA. The trademarks MLS®, Multiple Listing Service®, and the associated logos are owned by CREA and identify the quality of services provided by real estate professionals who are members of CREA.

The trademarks Royal LePage and Royal LePage Signature Realty are owned by their respective owners and used under licence.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Mona Osman and the Brokerage shall not be liable for any loss, damage, or harm of any kind — including direct, indirect, incidental, consequential, or punitive damages — arising from or related to your use of, or inability to use, this Site or any content on it, regardless of whether such liability arises in contract, tort, negligence, or otherwise.

This limitation applies even if Mona Osman or the Brokerage has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages; in such jurisdictions, our liability is limited to the greatest extent permitted by law.

9. Intellectual Property

All content on this Site — including but not limited to text, photographs, graphics, logos, page layouts, and design — is the property of Mona Osman, the Brokerage, or third parties from whom permission has been obtained, and is protected by applicable Canadian copyright and intellectual property laws.

You may access and view the content on this Site for your personal, non-commercial use only. You may not reproduce, distribute, modify, transmit, scrape, republish, train any model on, or otherwise use any content from this Site without the prior written consent of Mona Osman.

We do not control, endorse, or accept responsibility for the content, privacy practices, or terms of any third-party websites. Accessing any linked website is at your own risk.

11. Privacy

Personal information you submit through this Site — for example, your name, email address, phone number, and any details about your property search — is collected for the purpose of responding to your inquiry, providing real estate services, and complying with TRESA recordkeeping obligations. We will not sell, rent, or trade your personal information.

Personal information is handled in accordance with applicable Canadian privacy law, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and the Brokerage's privacy policy. You may contact Mona Osman with any privacy-related questions or requests.

12. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising from your use of this Site shall be subject to the exclusive jurisdiction of the courts of Ontario.
